2 2 Purpose of the presentation A brief overview of recent events concerning SARA: Listing decisions; Recovery strategies Petitions; and Judicial Reviews.

3 3 SARA - Listing 389 species in total on Schedule 1: 44 species added to the list this year Several species not added: Populations of Atlantic Cod Interior Fraser River Coho Salmon Beluga whale populations Porbeagle Shark Two populations White sturgeon Other species referred back to COSEWIC for further information and consideration

4 4 SARA – Recovery Strategies 17 finalized 6 currently posted for consultation Work is ongoing on over 150

5 5 SARA – Bilateral Agreements (s.10) Administrative agreements that promote inter- jurisdictional cooperation for the protection and recovery of species at risk Agreement with British Columbia is finalized 2 others in final stages, remainder at various stages of negotiation

6 6 SARA – Petitions? No formal process for petitions in the Act NGOs have adopted this format to request that the Minister exercise her powers

7 7 SARA – Petitions – Tiny C The plant species Tiny cryptanthe (endangered) and Small flowered Sand Verbena (threatened) are listed on Schedule 1 These two species are not prescribed in regulations under Albertas Wildlife Act Request that the Minister make a recommendation under s. 34(3)

8 8 SARA – Petitions – Tiny C 34 (3) The Minister must recommend that the order be made if the Minister is of the opinion that the laws of the province do not effectively protect the species or the residences of its individuals. 34(3) S'il estime que le droit de la province ne protège pas efficacement l'espèce ou la résidence de ses individus, le ministre est tenu de recommander au gouverneur en conseil la prise du décret.

9 9 SARA – Petitions – Woodland Caribou Woodland Caribou (boreal population) is listed as threatened on Schedule 1 A portion of this species occurs in Alberta Current populations have been estimated at below 1000 Canada-wide the Woodland Caribou (boreal population) is 35, ,000 individuals

10 10 SARA – Petitions – Woodland Caribou 80. (1) The Governor in Council may, on the recommendation of the competent minister, make an emergency order to provide for the protection of a listed wildlife species. (2) The competent minister must make the recommendation if he or she is of the opinion that the species faces imminent threats to its survival or recovery. 80. (1) Sur recommandation du ministre compétent, le gouverneur en conseil peut prendre un décret d'urgence visant la protection d'une espèce sauvage inscrite. (2) Le ministre compétent est tenu de faire la recommandation s'il estime que l'espèce est exposée à des menaces imminentes pour sa survie ou son rétablissement.

11 11 SARA – Judicial Review –Sakinaw Salmon This species is not listed on Schedule 1 An Assessment of Imminent Threat (requested under s. 28) was completed in the February 2006 Application for an order of mandamus, on the basis of delay, to require a Ministerial recommendation 2005 survey found 27 mature adults

(1) If the Minister is of the opinion that there is an imminent threat to the survival of a wildlife species, the Minister must, on an emergency basis, after consultation with every other competent minister, make a recommendation to the Governor in Council that the List be amended to list the species as an endangered species. 29. (1) Si le ministre est d'avis que la survie d'une espèce sauvage est menacée de façon imminente, il est tenu, après consultation de tout autre ministre compétent, de recommander d'urgence au gouverneur en conseil de modifier la liste pour y inscrire l'espèce comme espèce en voie de disparition.

15 15 SARA – Judicial Review – Tulsequah Chief Mining project undergoing environmental assessment under the CEAA Screening report indicates the access road for the mine has the potential to affect the East Atlin Woodland Caribou herd The herd is part of the Northern Mountain population of Woodland Caribou - listed as a species of special concern on Schedule 1 Section 79 of SARA is triggered JR seeking various declaratory relief and an injunction prohibiting the issuance of approvals and licences

16 16 SARA – Judicial Review – Tulsequah Chief 79. (2) The person must identify the adverse effects of the project on the listed wildlife species and its critical habitat and, if the project is carried out, must ensure that measures are taken to avoid or lessen those effects and to monitor them. The measures must be taken in a way that is consistent with any applicable recovery strategy and action plans. person includes an association or organization, and a responsible authority as defined in subsection 2(1) of the Canadian Environmental Assessment Act. 79.(2) La personne détermine les effets nocifs du projet sur lespèce et son habitat essentiel et, si le projet est réalisé, veille à ce que des mesures compatibles avec tout programme de rétablissement et tout plan daction applicable soient prises en vue de les éviter ou de les amoindrir et les contrôler. « personne » person « personne » Sentend notamment dune association de personnes ou dune organisation et dune autorité responsable au sens du paragraphe 2(1) de la Loi canadienne sur lévaluation environnementale.
