Le principe général / General Rule Lauteur est le titulaire unique, initial et perpétuel du droit moral sur les oeuvres de sa création. Le droit moral est exercé par le créateur de loeuvre lui- même et par ses héritiers. Lauteur est le titulaire initial des droits patrimoniaux et ses héritiers ou ayants droit à quelque titre que ce soit sont considérés comme des titulaires dérivés. The author is the sole, original and perpetual owner of the moral rights in works created by him. The right to exercise moral rights shall belong to the actual creator of the work and to his heirs. The author is the original owner of the economic rights, and his heirs or successors in title on whatever ground shall be considered secondary owners.

Oeuvres commandées/Works under hire Sauf convention contraire, la personne physique ou morale qui commande une oeuvre ou qui la produit avec la collaboration dautres personnes contre rémunération jouit de la titularité des droits patrimoniaux sur cette oeuvre et des prérogatives relatives à la divulgation, à lintégrité de loeuvre et à lélaboration de recueils en ce qui concerne ce type de créations. Unless otherwise agreed, the person, whether natural person or legal entity, who commissions the production of a work or produces such a work with others working for remuneration shall enjoy the ownership of the economic rights therein, and the rights relating to the disclosure and integrity of the work and the making of collections involving this type of creation shall accrue to him.

… Oeuvres commandées/Works under hire Quiconque participe à la réalisation de loeuvre, contre rémunération, jouit du droit dêtre expressément mentionné en tant quauteur ou artiste interprète ou exécutant en ce qui concerne la partie ou les parties de loeuvre à la création desquelles il a participé. The person who takes part in the making of the work against remuneration shall have the right to the express mention of his status as author or performer of the part or parts in the creation of which he has been involved.

Oeuvre dans le cadre dun contrat de travail/ work made in the course of employment Sagissant dune oeuvre créée dans le cadre dun emploi régi par un contrat de travail individuel établi par écrit, il est présumé, sauf convention contraire, que les droits patrimoniaux sont divisés en parts égales entre lemployeur et lemployé. In the case of a work made in the course of employment under an individual employment contract executed in writing, it shall be presumed, in the absence of agreement to the contrary, that the economic rights are shared equally between the employer and the employee.

…Oeuvre dans le cadre dun contrat de travail/ work made in the course of employment Lemployeur peut divulguer loeuvre sans lautorisation de lemployé, mais linverse nest pas possible. En labsence de contrat de travail individuel établi par écrit, les droits patrimoniaux appartiennent à lemployé. The employer may disclose the work without the employees authorization, but the reverse may not be done. In the absence of an individual employment contract executed in writing, the economic rights shall accrue to the employee.

Précision dimportance / Important remark Conforme à la loi mexicaine le droit dauteur nest pas lié à la propriété de lobjet matériel dans lequel loeuvre est incorporée. Sauf convention contraire expresse, laliénation par lauteur ou son ayant droit du support matériel dans lequel une oeuvre est incorporée, nemporte pas transfert à lacquéreur des droits patrimoniaux sur cette oeuvre. In accordance with the Mexican Law copyright shall not be conditional on the ownership of the physical object in which the work is embodied. Unless expressly agreed otherwise, the disposal by the author or his successor in title of the material medium containing a work shall not constitute transfer to the acquirer of any of the economic rights in the said work.

Cas spéciaux / Special cases Loeuvre audiovisuelle: Sauf convention contraire, le producteur est réputé être le titulaire des droits patrimoniaux sur lensemble de loeuvre. Sauf convention contraire entre les coauteurs, le directeur ou le réalisateur de loeuvre exerce le droit moral sur loeuvre audiovisuelle dans son ensemble, sans préjudice des prérogatives appartenant aux coauteurs à légard de leurs contributions respectives, ni de celles que peut exercer le producteur conformément à la loi. Audiovisual works: Unless otherwise agreed, the producer shall be considered the owner of the economic rights in the whole work. Unless otherwise agreed between the co-authors, the director or maker of an audiovisual work shall exercise the moral rights in the said work as a whole, without prejudice to the rights belonging to the other co-authors in relation to their own contributions, or to those that might be exercised by the producer in accordance with the Law.

…Cas spéciaux / Special cases …oeuvre audiovisuelle Une fois que les auteurs ou les titulaires des droits patrimoniaux se sont engagés à apporter leurs contributions en vue de la réalisation de loeuvre audiovisuelle, ils ne peuvent sopposer à la reproduction, la distribution, la représentation et lexécution publique, la transmission par câble, la radiodiffusion, la communication publique, le sous-titrage et le doublage des textes de cette oeuvre. Sans préjudice des droits des auteurs, le producteur peut accomplir tous les actes nécessaires à lexploitation de loeuvre audiovisuelle. …Audivisual work Once the authors or owners of economic rights have undertaken to make their contributions to the making of the audiovisual work, they may not object to the reproduction, distribution, public performance, cable distribution, broadcasting, communication to the public or subtitling and dubbing of the texts of the said work. Without prejudice to the rights of the authors, the producer may perform all such acts as are necessary for the exploitation of the audiovisual work.

Cas spéciaux / Special cases oeuvres photographiques, oeuvres des arts plastiques et graphiques: Sauf convention contraire, lauteur qui a aliéné une peinture, une sculpture ou une oeuvre des arts plastiques en général, est réputé avoir concédé à lacquéreur non pas le droit de la reproduire, mais celui de lexposer et de la faire figurer dans des catalogues. En tout état de cause, lauteur peut sopposer à lexercice de ces droits si lexposition a lieu dans des conditions préjudiciables à son honneur ou à sa réputation sur le plan professionnel. Les photographes professionnels ne peuvent exposer les photographies faites sur commande, pour témoigner de leur travail, sans une autorisation préalable. Photographic, Three-Dimensional and Graphic Works Unless otherwise agreed, the author who has disposed of his work of painting, sculpture or three- dimensional art in general shall be regarded as having granted the acquirer not the right to reproduce it, but the right to display it and include it in catalogues. In any event, the author may object to the exercise of those rights where the exhibition is conducted in a manner prejudicial to his honor or professional reputation. Professional photographers may only display photographs produced on commission, as specimens of their work, after authorization has been obtained.

…Cas spéciaux / Special cases Le portrait dune personne ne peut être utilisé ou publié sans le consentement exprès de celle-ci, ou de celui de ses mandataires ou des titulaires des droits y relatifs. Lorsquune personne se laisse photographier contre une rémunération, elle est présumée avoir donné le consentement visé dans lalinéa précédent et na pas le droit de le révoquer, à condition que la photographie soit utilisée dans les conditions et aux fins convenues. Sauf convention contraire, le droit exclusif de reproduire une oeuvre de peinture ou graphique ou une sculpture ninclut pas le droit de la reproduire dans nimporte quel type darticle ou en vue de faire la promotion commerciale de celui-ci. A portrait may only be used or published with the express consent of the person portrayed or that of his representatives or of the owners of the corresponding rights. When a person allows his portrait to be made against remuneration, it shall be presumed that he has given the consent referred to in the foregoing paragraph and shall not have the right to revoke it, provided that the portrait is used in the manner and for the purposes agreed. Unless otherwise agreed, the exclusive right to reproduce a pictorial or graphic work or a work of sculpture does not include the right to reproduce it on any kind of article, or for the commercial advertising of such an article.

…Cas spéciaux / Special cases Oeuvres darchitecture Sauf convention contraire, lauteur dune oeuvre darchitecture ne peut empêcher le propriétaire de celle-ci de lui apporter des modifications, mais a la faculté dinterdire que son nom soit associé à loeuvre modifiée. Architectural works Unless otherwise agreed, the author of a work of architecture may not prevent the owner of the said work from making alterations, but he shall have the right to prohibit his name from being associated with the work so altered.

…Cas spéciaux / Special cases Oeuvres darts appliqués Les dispositions auparavant sont applicables aux oeuvres des arts appliqués en ce quelles ont doriginal. Lutilisation de ces oeuvres ne fait lobjet daucune protection. Works of applied art The abovementioned provisions shall apply to those aspects of works of applied art that are original. The use to which those works are put shall not be eligible for protection.

…Cas spéciaux / Special cases les symboles de la patrie LÉtat mexicain est le titulaire du droit moral sur les symboles de la patrie. Lutilisation des symboles de la patrie doit être conforme aux dispositions de la loi sur le blason, le drapeau et lhymne de la nation. National Symbols The Mexican State is the owner of the moral rights in national symbols. The use of national symbols shall conform to the provisions of the Law on the National Coat of Arms, Flag and Anthem.

…Cas spéciaux / Special cases Les expressions de la culture populaire (folklore) Les oeuvres littéraires, artistiques, de lart populaire ou de lartisanat peuvent être utilisées librement à condition quelles ne soient pas utilisées en les déformant ou que lutilisation ne soit pas visant à dévaloriser la communauté ou lethnie en question ou à porter préjudice à la réputation ou à limage de la communauté ou de lethnie à laquelle elles appartiennent. Il convient de mentionner le nom de la communauté ou de lethnie, ou, le cas échéant, de la région de la République mexicaine, à laquelle elle appartient. Popular Culture (folklore) The use of the literary or artistic works, works of popular art or craft works shall be free, provided that they are used without any distortion intended to discredit the said works or prejudice the reputation or image of the community or ethnic group to which they belong. The community or ethnic group or, where appropriate, the region of the Mexican Republic to which it is specific, shall be mentioned.
