5 THE DIFFERENT APPROACH OF COMMON LAW JURISDICTIONS L’APPROCHE DIFFERENT DANS LES PAYS DE COMMON LAW Parties of common law countries will take precautions that are not usual in civil law countries (e.g. professional privilege) Les parties des pays de common law prennent des precautions non usuelles dans le pays de civil law (par ex. professional privilege)

7 WRITTEN WITNESS STATEMENTS SHOULD NOT LIMIT THE RIGHT OF THE PARTIES TO PRESENT THEIR CASE LE DECLARATIONS ECRITES DES TEMOINS NE DEVRAIT PAS LIMITER LE DROIT DES PARTIES DE PRESENTER LEUR CAS The witness (and especially the party) should be able to make a full oral presentation of his/her position Le témoin (et en particulier la partie) devrait pouvoir faire un présentation orale complète de sa position.

9 THE NEED TO WARRANT EQUAL TREATMENT IN CROSS-EXAMINATION LA NECESSITE DE GARANTIR UN TRAITEMENT EQUITABLE DANS LA “CROSS-EXAMINATION” Aggressive cross examination by common law counsel should not be permitted if the opposing counsel does not have the same preparation/skill Une cross-examination aggressive ne devrait être admise lorsque l’avocat de l’autre partie n’a pas la même préparation/compétence

10 CONCLUSION WARRANTING EQUAL TREATMENT IN THE FRAMEWORK OF A FLEXIBLE APPROACH CONCLUSION GARANTIR L’EGALITE DES PARTIES DANS LE CADRE D’UNE APPROCHE FLEXIBLE The principle of equal tratment should always prevail over any procedural rules. This is why arbitrators should avoid to be bound by too specific rules Le principe d’égalité des parties devrait toujours prévaloir sur toute règle de procédure. C’est pour cette raison que les arbitres devraien éviter d’être liés par des règles trop spécifiques
