Questioning of permanence as a criterion for the protection of the fictional character

Part of the authors adds a condition of permanence This condition of permanence is employed: With regard to physical appearance (I) With regard to its psychology, its personality(II) Cette condition de permanence est employée: A propos de l’apparence physique (I) A propos de la psychologie, de la personnalité du personnage (II)

What is the justification of such a condition? Is it timely? What does « permanence » mean? The fictional character is condemned to the inertia… Or Can it evolve as long as it stays recognizable…? Quelle est la justification d’une telle condition? Est elle opportune? Que signifie le terme « permanence »? Le personnage est condamné à l’inertie… Ou Peut-il évoluer tant qu’il reste reconnaissable…?

I- About the physical permanence Accordinf to Bernard Edelman the fictionnal character is frozen in these first characteristics. But, often, the author makes his character evolving as time goes by. Selon Bernard Edelman le personnage est figé dans ses premières caractéristiques. Mais, souvent, l’auteur fait évoluer son personnage au fil du temps. It would seem that for him/ could make it lost its protection right/ makes his character evolving as time goes by/ have even been profundly modified

Examples:

Conclusion The repetition of the character’s features and its nature makes easier its identification and assessement or its originality but isn’t a decisive characteristic of the protection. La répétition des traits et du caractère du personnage sont utiles pour l’identifier et pour apprécier son originalité mais ne sont en aucun cas un critère déterminant pour sa protection.
